On Friday (30th August 2024), Brazil imposed a nationwide suspension on the social media platform X, following a confrontation between the country’s judiciary and the platform’s owner, Elon Musk. The Brazilian Supreme Court, led by Justice Alexandre de Moraes, ordered the shutdown after X failed to adhere to legal requirements and court directives. This decision marks a significant moment in Musk’s efforts to reshape X into a more open digital forum.

Legal Dispute and Enforcement

The conflict began when Justice Moraes mandated that X cease operating in Brazil unless it appointed a local legal representative. Moraes’ ruling came after X ignored multiple court orders to remove accounts that allegedly spread misinformation and hate speech. In response to X’s non-compliance, Musk closed X’s office in Brazil, leading to heightened tensions between the platform and Brazilian authorities.

Impact on SpaceX and Starlink

In an unprecedented move, Justice Moraes also froze assets of SpaceX’s Starlink satellite internet service in Brazil to enforce a $3 million fine against X. Starlink, which has gained substantial traction in Brazil with over 250,000 users, vowed to contest the freeze and promised to offer free service if necessary to counteract the financial penalties.

Public and Legal Reactions

Initially, Moraes announced that individuals using VPNs to bypass the X ban would face fines up to $9,000. This measure faced swift backlash from Brazilian citizens and academics, leading to its reversal in a revised order later that day. The Supreme Court emphasized the need to curb the spread of false information and ensure compliance with Brazilian laws during the upcoming municipal elections.

Musk’s Response and Future Actions

Elon Musk criticized Justice Moraes publicly, labeling him as an “evil dictator cosplaying as a judge” on X. Despite the ongoing legal struggle and fines, Musk has yet to formally address the latest developments or provide a response to the Brazilian judiciary’s actions. The Supreme Court has mandated that the X app be removed from digital storefronts within five days, affecting its availability to users across the country.
